Lea detenidamente estos documentos. Si no está de acuerdo con alguna de las disposiciones aquí establecidas, deberá abstenerse de utilizar el Servicio y abandonar la plataforma de inmediato.\u003C\u002Fp>\u003Cp>Nos reservamos el derecho de modificar, actualizar o reemplazar estos Términos en cualquier momento y a nuestra entera discreción, con el fin de adaptarnos a cambios legislativos, tecnológicos o de nuestro modelo de negocio. En caso de realizar cambios sustanciales, notificaremos a los usuarios con cuenta activa mediante el correo electrónico registrado con al menos quince (15) días de antelación a su entrada en vigor. Requisitos de Edad y Acceso al Servicio\u003C\u002Fstrong>\u003C\u002Fh2>\u003Cp>BumBum Comics aloja novelas gráficas, ilustraciones y narrativas de romance erótico dirigidas exclusivamente a un público adulto. El Servicio contiene representaciones de desnudez y conductas de naturaleza sensual o sexual explícitas.\u003C\u002Fp>\u003Cul>\u003Cli>Mayoría de Edad: para registrarse, adquirir membresías o interactuar con el Servicio, usted debe tener obligatoriamente al menos dieciocho (18) años de edad (o la mayoría de edad legal establecida en su país, estado o jurisdicción de residencia).\u003C\u002Fli>\u003Cli>Declaración Jurada de Edad: al acceder a la Plataforma y superar de manera activa nuestro Pop-up de verificación de edad, usted declara bajo gravedad de juramento que cumple con el requisito de mayoría de edad.\u003C\u002Fli>\u003Cli>Prohibición de Acceso a Menores: queda estrictamente prohibido el acceso de menores de 18 años al Servicio. Si BumBumComics detecta o sospecha que una cuenta pertenece a un menor de edad, procederá a la cancelación inmediata de la cuenta y a la restricción permanente del acceso a la plataforma sin derecho a reembolso alguno.\u003C\u002Fli>\u003C\u002Ful>\u003Ch2>\u003Cstrong>3. Registro, Cuentas de Usuario y Seguridad\u003C\u002Fstrong>\u003C\u002Fh2>\u003Cp>Para acceder a determinadas funciones del Servicio, como la visualización de capítulos exclusivos, la participación en votaciones o la compra de contenido, se requiere la creación de una cuenta de usuario:\u003C\u002Fp>\u003Cul>\u003Cli>Veracidad de los Datos: al registrarse, se compromete a proporcionar información exacta, actualizada y completa. Debe registrarse utilizando una dirección de correo electrónico válida y de su propiedad. Si opta por el registro mediante redes sociales integradas (como Facebook), debe emplear credenciales personales activas.\u003C\u002Fli>\u003Cli>Responsabilidad de Comunicación: el uso de correos electrónicos inválidos, temporales o de terceros exime a la Empresa de responsabilidad ante la falta de recepción de notificaciones críticas, alertas de seguridad, facturación o actualizaciones del Servicio.\u003C\u002Fli>\u003Cli>Carácter Personal e Intransferible: cada cuenta de BumBum Comics es de uso estrictamente personal, privado y no comercial. Queda expresamente prohibido vender, alquilar, ceder o transferir su cuenta o sus credenciales de acceso a terceros.\u003C\u002Fli>\u003Cli>Seguridad de Credenciales: usted es el único responsable de mantener la confidencialidad de su contraseña y de todas las actividades, transacciones y consumos que ocurran bajo su cuenta. No debe permitir que terceros accedan a su cuenta. En caso de sospechar o confirmar un acceso no autorizado o violación de seguridad, debe notificarlo de inmediato escribiendo a: info@bumbumcomics.com.\u003C\u002Fli>\u003Cli>Restricción de Nombres de Usuario: nos reservamos la facultad de restringir, modificar o suspender nombres de usuario en casos donde exista posibilidad de fuga de información personal, si el nombre es considerado antisocial, ofensivo, contrario a las buenas costumbres, o si induce a confusión simulando ser un administrador o empleado de la Plataforma.\u003C\u002Fli>\u003C\u002Ful>\u003Ch2>\u003Cstrong>4. Ecosistema de Pago Recurrente (Membresía VIP) y Recaudo Directo\u003C\u002Fstrong>\u003C\u002Fh2>\u003Cp>A. Suscripción Directa en BumBumComics.com (WOMPI) — usted puede adquirir la condición de \"Miembro VIP\" directamente en nuestro sitio web oficial mediante el pago de una tarifa de suscripción mensual recurrente:\u003C\u002Fp>\u003Cul>\u003Cli>Pasarela de Pago Autorizada: los pagos directos en nuestra plataforma son procesados y recaudados de forma segura a través de WOMPI (pasarela de pagos operada por Comercio Electrónico de Colombia S.A.S. o sus filiales). Al realizar un pago, usted autoriza a WOMPI a realizar los cargos correspondientes a su Método de Pago seleccionado.\u003C\u002Fli>\u003Cli>No Almacenamiento de Datos Financieros: BumBum Comics no almacena, procesa ni tiene acceso a los números de sus tarjetas de crédito, débito o credenciales de cuentas bancarias. Toda transacción se realiza bajo el entorno encriptado y certificado PCI DSS de WOMPI.\u003C\u002Fli>\u003Cli>Facturación Recurrente Automática: al suscribirse a la membresía VIP en nuestra web, usted acepta y autoriza que el cobro de la tarifa mensual se realice de manera automática y recurrente cada mes en la fecha correspondiente a su ciclo de facturación (coincidiendo con el día del mes en que realizó la compra inicial).\u003C\u002Fli>\u003Cli>Duración del Servicio y Cancelación: usted puede cancelar su pago recurrente en cualquier momento a través del panel de configuración de su perfil de usuario antes de la fecha de su próxima renovación. Tras la cancelación, podrá seguir disfrutando del acceso VIP durante el tiempo restante de su ciclo mensual ya pagado (excluyendo los días consumidos). Una vez finalizado dicho periodo, la membresía no se renovará y se revocará el acceso VIP.\u003C\u002Fli>\u003Cli>Fallos de Transacción: si por expiración del método de pago, fondos insuficientes o cualquier otra razón ajena a la Empresa, el cobro automático no puede ser procesado por WOMPI en la fecha límite, el sistema suspenderá temporalmente el acceso a la membresía VIP hasta que se registre un método de pago válido y se liquide el saldo pendiente.\u003C\u002Fli>\u003C\u002Ful>\u003Cp>B. Suscripción Mediante Plataformas Satélites de Terceros — con el fin de diversificar nuestras opciones de ingresos y aprovechar la infraestructura global de plataformas de micromecenazgo y suscripción para adultos, BumBum Comics comercializa accesos, recompensas de co-creación y contenido erótico VIP en canales externos oficiales como Patreon, OnlyFans y Fansly. Al suscribirse o realizar transacciones en nuestros perfiles VIP de Patreon, OnlyFans o Fansly, usted reconoce y acepta que dichas transacciones financieras y la entrega técnica de esas ventajas específicas se rigen bajo los Términos de Servicio, Políticas de Reembolso, Impuestos (como el IVA de la UE o impuestos locales de EE. UU.) y directrices de cobro de esas respectivas plataformas. Todo el contenido alojado en el Servicio —incluyendo pero no limitado a novelas gráficas, cómics, personajes, diálogos, bocetos, logotipos, imágenes, audios y textos— es propiedad exclusiva de BumBumComics S.A.S. y del equipo creativo liderado por el artista Jhon Vásquez y el guionista Wilfredo Jiménez.\u003C\u002Fp>\u003Cul>\u003Cli>100% Arte Humano: garantizamos a nuestra comunidad que todo el contenido comercializado y publicado es de creación humana real, libre de generación algorítmica automatizada.\u003C\u002Fli>\u003Cli>Prohibición de Uso para Inteligencia Artificial: queda estrictamente prohibida la descarga, recolección, extracción de datos (scraping), reproducción, almacenamiento o uso de cualquier cómic, personaje, ilustración o elemento visual de BumBum Comics para alimentar, entrenar, refinar, validar o desarrollar modelos de Inteligencia Artificial (IA) generativa, algoritmos de aprendizaje profundo (machine learning) o sistemas computacionales de clonación artística.\u003C\u002Fli>\u003Cli>Acciones Legales: cualquier uso no autorizado para entrenamiento de IA o la piratería de nuestro material erótico digital será considerado una violación grave a los derechos de autor internacionales y será perseguido legalmente mediante reclamos de derechos de propiedad intelectual (DMCA) y las acciones judiciales pertinentes ante la jurisdicción colombiana (bajo la Ley 23 de 1982) e internacional.\u003C\u002Fli>\u003C\u002Ful>\u003Ch2>\u003Cstrong>6. Derechos de Autor de los Contenidos y Limitación de Copia \u002F Descarga\u003C\u002Fstrong>\u003C\u002Fh2>\u003Cp>Los cómics, bocetos e ilustraciones distribuidos de forma gratuita o mediante la modalidad de membresía VIP están destinados única y exclusivamente para el disfrute personal y no comercial de los Usuarios registrados.\u003C\u002Fp>\u003Cul>\u003Cli>Prohibición de Explotación: no podrá reproducir, distribuir, alquilar, arrendar, vender, licenciar, copiar, modificar o utilizar de otra manera la información o material que haya obtenido a través de nuestro Servicio con fines de lucro o comercialización.\u003C\u002Fli>\u003Cli>Tolerancia Cero contra Filtraciones (Anti-Leaks): queda prohibida la extracción de contenidos usando capturas de pantalla (screenshots), grabaciones de video en pantalla, software de ripeo o cualquier otro procedimiento de duplicación digital. Cualquier acto detectado en este sentido se considerará una infracción grave a la Ley de Derechos de Autor.\u003C\u002Fli>\u003Cli>Consecuencias de la Infracción: la realización de conductas prohibidas de extracción o piratería facultará a BumBumComics S.A.S. a dar por terminada la cuenta del Usuario infractor de forma definitiva y sin derecho a reembolso de ningún tipo, reservándose el derecho de iniciar las acciones judiciales penales o civiles pertinentes.\u003C\u002Fli>\u003C\u002Ful>\u003Ch2>\u003Cstrong>7. Regulación de Contenidos y Compliance Adulto (+18)\u003C\u002Fstrong>\u003C\u002Fh2>\u003Cp>BumBum Comics es un espacio artístico y literario enfocado en la fantasía erótica:\u003C\u002Fp>\u003Cul>\u003Cli>Obras de Ficción: todo el contenido (visual, narrativo e interactivo) representa obras de ficción y fantasía artística.\u003C\u002Fli>\u003Cli>Personajes Adultos: todos los personajes involucrados en conductas sensuales, eróticas o de romance son e interpretan de manera estricta a adultos mayores de edad (+18), tanto en su aspecto físico, contexto de historia como descripción psicológica.\u003C\u002Fli>\u003Cli>Consentimiento Obligatorio: promovemos exclusivamente historias basadas en relaciones plenamente consensuadas.\u003C\u002Fli>\u003Cli>Protección de Menores: BumBumComics S.A.S. mantiene una política de tolerancia cero frente a contenidos ilegales. Queda estrictamente prohibida la publicación, promoción, solicitud o distribución de cualquier tipo de material, texto o conducta que involucre o insinúe actos no consentidos, violencia excesiva o actividades sexuales con menores de edad. Cualquier contenido que viole esta disposición será eliminado inmediatamente tras su identificación, y el perfil responsable será suspendido permanentemente y denunciado ante las autoridades nacionales e internacionales correspondientes.\u003C\u002Fli>\u003C\u002Ful>\u003Ch2>\u003Cstrong>8. Obligaciones de BumBum Comics y de los Usuarios\u003C\u002Fstrong>\u003C\u002Fh2>\u003Cp>A. Obligaciones de BumBum Comics S.A.S. — no vendemos, alquilamos ni compartimos la información personal que nos proporciona para usar el Servicio con terceros sin su consentimiento previo, a menos que sea requerido por una orden judicial o autoridades de control competentes en cumplimiento de la Ley 1581 de 2012 (Habeas Data en Colombia) y el GDPR en el caso de tráfico procedente de la Unión Europea. Nos comprometemos a tomar medidas razonables para resolver las quejas o incidencias técnicas reportadas por los usuarios con respecto al Servicio a la mayor brevedad posible, a través de nuestro canal de soporte técnico coordinado por Jorge Armando Arenas. Realizaremos esfuerzos comerciales proporcionales para mantener el Servicio activo en todo momento y reducir los inconvenientes técnicos en el uso de la Plataforma.\u003C\u002Fp>\u003Cp>B. Obligaciones de los Usuarios — usted declara, garantiza y se compromete a no realizar ninguna de las siguientes conductas al hacer uso de la Plataforma:\u003C\u002Fp>\u003Cul>\u003Cli>Ingresar información falsa o inexacta al crear o modificar su cuenta de usuario.\u003C\u002Fli>\u003Cli>Suplantar la identidad de un empleado, administrador, artista (como Jhon Vásquez) o colaborador de BumBum Comics, así como usar nombres de terceros de forma fraudulenta en comunicaciones y correos electrónicos.\u003C\u002Fli>\u003Cli>Utilizar de manera ilegal o sin autorización la cuenta, contraseña o ID de usuario de otro miembro de la Plataforma.\u003C\u002Fli>\u003Cli>Vender, ceder o transferir su cuenta del Servicio o su suscripción VIP a terceros.\u003C\u002Fli>\u003Cli>Interrumpir el orden público, la convivencia o violar la ley enviando, publicando o distribuyendo a terceros frases, imágenes, sonidos o videos que puedan causar acoso, difamación, vergüenza, odio o miedo a otros usuarios.\u003C\u002Fli>\u003Cli>Registrar o distribuir intencionalmente virus informáticos, malware, troyanos o cualquier código malicioso diseñado para dañar, destruir, alterar o causar un mal funcionamiento en los equipos de computación o servidores relacionados con la Plataforma.\u003C\u002Fli>\u003Cli>Enviar publicidad no autorizada, anuncios invasivos, correos masivos (spam) o mensajes comerciales contra la clara negativa de los receptores.\u003C\u002Fli>\u003Cli>Recopilar, almacenar o revelar información personal de otros usuarios sin su consentimiento expreso y por escrito.\u003C\u002Fli>\u003Cli>Realizar contracargos fraudulentos (Friendly Fraud) o reportar cobros legítimos de BumBum Comics como \"no reconocidos\" ante su banco o ante WOMPI tras haber visualizado, leído o consumido el contenido VIP. Esta conducta se considerará fraude comercial y habilitará la suspensión de la cuenta.\u003C\u002Fli>\u003C\u002Ful>\u003Ch2>\u003Cstrong>9. Modificación, Suspensión y Terminación del Servicio\u003C\u002Fstrong>\u003C\u002Fh2>\u003Cp>Podemos, por razones técnicas, operativas o comerciales, modificar, enmendar o cambiar el Servicio en su totalidad o en cualquiera de sus partes. Asimismo, nos reservamos el derecho de restringir, suspender o interrumpir el acceso a la Plataforma (total o parcialmente) de forma temporal en las siguientes circunstancias:\u003C\u002Fp>\u003Cul>\u003Cli>Durante labores de instalación, reparación, mantenimiento o inspección de los servidores e infraestructura del Servicio.\u003C\u002Fli>\u003Cli>Cuando los proveedores de telecomunicaciones (en virtud de la Ley 1341 de 2009 de Colombia o normativas locales aplicables) suspendan, restrinjan o limiten sus servicios de red.\u003C\u002Fli>\u003Cli>En caso de fallas eléctricas generalizadas, fallas imprevistas de equipos, congestión extrema o sobrecarga de tráfico de internet que impida el correcto funcionamiento de la web.\u003C\u002Fli>\u003Cli>Por la ocurrencia de eventos de fuerza mayor o caso fortuito incontrolables, tales como desastres naturales, pandemias, emergencias nacionales, disturbios civiles o cambios regulatorios y normativas administrativas que restrinjan el negocio.\u003C\u002Fli>\u003Cli>Ante la finalización o terminación de contratos o licencias entre los creadores o proveedores de contenido (ilustradores, coloristas) y nosotros, lo cual podrá causar la suspensión inmediata de la visualización o venta de ciertos contenidos específicos en la Plataforma.\u003C\u002Fli>\u003C\u002Ful>\u003Cp>Nota: en caso de que un cambio operativo o fusión comercial comprometa permanentemente la entrega de contenidos previamente pagados, BumBum Comics notificará con antelación a los usuarios y tomará medidas razonables y proporcionales para detener o mitigar cualquier daño financiero directo que estos puedan sufrir.\u003C\u002Fp>\u003Ch2>\u003Cstrong>10. Cancelación, Reembolsos y Contracargos\u003C\u002Fstrong>\u003C\u002Fh2>\u003Cp>A. Política de Reembolso para Membresías VIP Directas — debido a la naturaleza digital del contenido de BumBum Comics (el cual se desbloquea de forma inmediata en línea para su consumo una vez efectuado el pago):\u003C\u002Fp>\u003Cul>\u003Cli>Derecho de Retracto Limitado: el usuario podrá solicitar un reembolso de su compra de pago recurrente únicamente dentro de los catorce (14) días calendario posteriores a la compra, SI Y SOLO SI no ha accedido, visualizado o descargado ningún tipo de contenido exclusivo para cuentas VIP durante dicho período de catorce (14) días. El consumo de una sola viñeta, boceto o página VIP extingue inmediatamente cualquier derecho de reembolso o retracto, considerándose el servicio plenamente ejecutado de conformidad con el artículo 47 de la Ley 1480 de 2011 (Estatuto del Consumidor de Colombia).\u003C\u002Fli>\u003Cli>Exclusiones: si el usuario accede a cualquier beneficio VIP durante el plazo de 14 días, no se otorgará reembolso bajo ninguna circunstancia.\u003C\u002Fli>\u003Cli>B. Limitaciones del Proveedor de Pagos y Métodos de Pago en Efectivo: algunos métodos de pago, particularmente aquellos basados en efectivo, corresponsales bancarios físicos (Efecty u otros) o transferencias manuales procesadas por WOMPI, pueden no ser técnicamente reembolsables de forma monetaria directa debido a limitaciones inherentes del procesador de pagos. Cualquier compra incorrecta o cobro duplicado directamente imputable a una falla de nuestra Plataforma será reembolsado en su totalidad mediante el mismo método de pago original. Si esto no es técnicamente viable por limitaciones de la pasarela, BumBum Comics coordinará con el usuario para realizar la devolución a través de un canal alternativo o, en su defecto, compensará al usuario mediante créditos de saldo en tienda o la extensión de tiempo de su membresía VIP equivalente en bumbumcomics.com.\u003C\u002Fli>\u003C\u002Ful>\u003Cp>C. Consecuencias de Contracargos e Intentos de Fraude — la apertura de disputas financieras o contracargos malintencionados por parte del Usuario se tratará con política de tolerancia cero: si el Usuario ejecuta un contracargo ante su entidad bancaria para eludir el pago de contenidos que ya han sido visualizados o descargados, su cuenta en BumBum Comics será terminada permanentemente sin previo aviso. La dirección IP y los datos del Usuario serán inhabilitados en nuestros servidores y reportados a las bases de datos de seguridad de pasarelas de pago y centrales de riesgo correspondientes para prevenir futuros fraudes.\u003C\u002Fp>\u003Ch2>\u003Cstrong>11. Política de Compensación por Fallos del Servicio\u003C\u002Fstrong>\u003C\u002Fh2>\u003Cp>En el evento excepcional de que la Plataforma experimente una caída crítica, fallo técnico prolongado o indisponibilidad imprevista imputable directamente a nuestros servidores que impida a los Miembros VIP acceder a sus beneficios:\u003C\u002Fp>\u003Cul>\u003Cli>Condición de Aplicación: la indisponibilidad del Servicio debe ser continua y superar un período ininterrumpido de cuarenta y ocho (48) horas consecutivas.\u003C\u002Fli>\u003Cli>Forma de Compensación: BumBum Comics compensará a los usuarios afectados con Pago Recurrente activo mediante la adición de tiempo de suscripción gratuito proporcional al tiempo que el Servicio permaneció fuera de línea o mediante créditos utilizables dentro de la Plataforma. Esta compensación no aplicará si la inactividad es causada por fallos del proveedor de internet del usuario, cortes de energía locales u otras causas de fuerza mayor detalladas en la Sección 9.\u003C\u002Fli>\u003C\u002Ful>\u003Ch2>\u003Cstrong>12. Indemnización\u003C\u002Fstrong>\u003C\u002Fh2>\u003Cp>Usted acepta mantener indemne, defender y exonerar de toda responsabilidad a BumBumComics S.A.S., sus accionistas, directores, administradores, artistas, programadores y empleados (incluyendo gastos y honorarios razonables de abogados) frente a cualquier pérdida, reclamo, daño, demanda, responsabilidad o sanción administrativa que surja de o esté relacionada con: su uso indebido o ilegal del Servicio; su violación de estos Términos de Servicio, la Política de Privacidad o cualquier ley o regulación aplicable; o cualquier infracción a los derechos de propiedad intelectual de BumBum Comics cometida por usted o mediante el uso de su cuenta.\u003C\u002Fp>\u003Cp>Excepción: no se requerirá que usted indemnice a BumBum Comics si la pérdida o reclamo no fue causado de manera intencional o negligente por su parte, o si se demuestra que el evento estuvo completamente fuera de su control.\u003C\u002Fp>\u003Ch2>\u003Cstrong>13. Limitaciones de Responsabilidad\u003C\u002Fstrong>\u003C\u002Fh2>\u003Cp>BumBum Comics y su equipo realizan esfuerzos significativos para garantizar una experiencia óptima y segura.
